Matouk Bassiouny & Hennawy (“MBH”) has secured a landmark judgment dismissing, in its entirety, a medical liability claim exceeding EGP 200 million, brought against one of the leading medical institutions in the Kingdom of Saudi Arabia.
The claim, brought before the Egyptian courts against the hospital and the treating physician, alleged that surgical procedures performed in 2021 had resulted in permanent quadriplegia, and sought damages exceeding EGP 200 million against the defendants jointly.
MBH’s Litigation team advanced a comprehensive strategy challenging both the factual and medical foundations of the claim. Through compelling documentary evidence, expert submissions, and strategic advocacy, the team demonstrated that the Claimant’s assertions were inconsistent with the objective medical evidence.
Given the technical nature of the dispute, the Court referred the matter to the Egyptian Forensic Medicine Authority for expert examination.
In a notable procedural achievement, MBH obtained an exceptional interlocutory judgment permitting the defendants and their representatives to attend the medical examination sessions — ensuring full transparency throughout the process.
The Authority ultimately concluded that the treatment provided by the hospital was fully consistent with accepted medical standards and that no malpractice had occurred.
Relying on these findings, the Court dismissed the claim in its entirety — a complete victory for MBH’s client.
