Eslam is a senior associate at Matouk Bassiouny & Hennawy’s dispute resolution practice group. He has been practicing dispute resolution for seven years in both Litigation and Arbitration. He joined Matouk Bassiouny & Hennawy in 2016. Prior to joining Matouk Bassiouny, he worked at Khalifa & Associates in Cairo, Egypt and the Law Office of Alan M. Parra in Maryland, USA.
He is admitted before the Egyptian Bar Association since 2013 and is holder of LL.M in International Business Law & International Commercial Arbitration from American University, Washington College of Law since 2014.
Eslam practices, both plaintiff and defendant work as well as settlement negotiations, in commercial disputes with an industry focus on commercial agency, distribution, technology transfer, employment, heritage and criminal matters. In parallel to that, Eslam has strong experience in enforcement of foreign/domestic commercial awards in Egypt.
Eslam advised major and multinational clients in addition to States such as Etisalat Misr, Emirates International Investment Company, CIB, Union Fenosa Gas, Melia Hotels International, ENAP Sipetrol, Bel Egypt Expansion, Confederation Africane De Football, Nestle Egypt, Sweden Embassy in Egypt, Bahraini Embassy in Egypt, NAVAL Group, NCR Company, MAERSK Drilling Holding Singapore, The Egyptian Company for pre-stressed Concrete Company (ECPC), Americana, Khartoum State (The Republic of Sudan), Cargill Company, Misr Beni Suef Cement Company, and Nesco Tourism Investments Co.
Practice Focus
Eslam’s practice focus is on commercial, civil, employment, hotel management and taxation disputes. He also represents clients before Egyptian Courts. He practices in the various stages of a commercial agency/distribution relation, including drafting agreements, advising on termination, handling disputes and concluding settlements. During his work period at the Arbitration Department, Eslam handled international and domestic arbitration cases and represented companies in several high-level complex in arbitration disputes under most major institutional rules including ICC, CRCICA and UNCITRAL in relation to disputed amounts in excess of USD 2 billion involving telecommunications and interconnection, oil and gas, construction projects and hotel management. Eslam advised major companies in several commercial and arbitration disputes. Eslam has also acted as a secretary to an arbitrator member of a CRCICA tribunal. Eslam also represented clients in several annulment lawsuits with respect to CRCICA rendered arbitral awards along with the enforcement procedures.
Selected Recent Experience
- Representing several clients in disputes among tenants and landlords in light of the Egyptian reforms in the real estate market.
- Representing and advising major companies in commercial, civil, employment and taxation disputes along with representing them before the Egyptian Courts, the Public Prosecution and the Governmental Authorities.
- Advising several companies in several matters with respect to the Egyptian law and for instance, VAT on concession agreements, serving English proceedings in Egypt, legal advice for the Diplomatic Immunity and its application in the Egyptian territory, legal advice regarding the construction works on the side of the Nile and how this affect the embassies, legal advice with respect to the tax evasion under Egyptian law, and assessing and advising on several arbitral awards in light of the annulment reasons.
- Successfully representing Confédération Africaine de Football (CAF) in several employment matters encompass handling all the paperwork such as preparing the notices of termination, conducting the meetings with the employees, negotiating their dues in light of the contract and the Internal Employment Regulation in order to achieve a peaceful exist.
- Representing clients before the Tax Evasion Department in several tax matters which include tax evasion conducts/acts along with providing several clients with legal opinions/advice in such matters.
- Successfully representing a major American Company in conducting internal investigation in light of the Foreign Corrupt Practices Act (FCPA).
- Participating in the Task Force Committee responsible for Digitalizing Judicial Proceedings in Egypt at the Ministry of Justice.
- Handling litigation cases or proceedings pertaining to arbitration cases such as nullity actions brought up before the Egyptian Courts against arbitration awards and also all the enforcement proceedings for the same in parallel.
- Representing and advising several embassies in different matters related to insurance companies.
- Representing and advising heirs in a complex heritage matter with respect to several Declaration of Inheritances for the sake of proving our client’s part.
- Representing Khartoum State (The Republic of Sudan) in obtaining an annulment court judgment rendered in an annulment lawsuit filed against CRCICA arbitral award with an excess amount of USD 1,672,267,000 (One billion six hundred seventy-two million two hundred sixty-seven thousand American Dollar) issued in favor of a Kuwaiti leading construction and real-estate investment company.
- Successfully representing and advising a major European Oil & Gas Corporation in several high-level complex ICC and CRCICA arbitrations in excess of USD 2 billion.
- Successfully representing and advising a leading Telecommunication Company in an interconnection dispute in a CRCICA arbitration in excess amount of EGP 700,000,000.
- Representing and advising a Spanish Company in a hotel management and hospitality dispute in a CRCICA arbitration in excess amount of USD 2,500,000.
- Successfully representing and advising an Indian Company in a logistic Trucking and Customs Clearance Services in a CRCICA arbitration in excess amount of EGP 13,000,000.
